Terms and Conditions of Sale
This English translation is provided for convenience only. In the event of any discrepancy or dispute, the French version shall prevail.
These general terms and conditions of sale (hereinafter the “Terms of Sale”) define the rights and obligations of the parties in connection with the distance selling of products offered by T-BUMP (hereinafter “T-BUMP”, “the Seller” or “we”) on the website www.t-bump.com (hereinafter “the Site”), to any consumer who is a natural person acting for non-professional purposes (hereinafter “the Customer” or “you”).
T-BUMP is a curatorial platform that selects and sells creations designed by independent designers (hereinafter the “Designers”). Whichever Designer is behind a Product, the sales contract concluded through the Site is exclusively between the Customer and T-BUMP. T-BUMP is therefore the Customer's sole point of contact for any question relating to their order, delivery, return, refund or warranty. The Customer does not need to contact a Designer directly.
Any order placed on the Site implies full and unreserved acceptance of these Terms of Sale. T-BUMP may amend these Terms of Sale. The applicable Terms of Sale are those in force on the date of the order.

Article 2. Scope
These Terms of Sale apply to any sale of Products concluded by a Customer on the Site.
Article 3. The Products and the Designers
3.1 Description. The Products are described and presented as accurately as possible. The essential characteristics shown on the product page are binding on T-BUMP. A slight difference in shade may appear depending on the screen. It does not detract from the essential characteristics of the Product.
3.2 Handmade pieces. Many Products are designed and made by hand or in very small series by the Designers. Slight variations in shade, texture, finish or dimensions may exist from one piece to another. They are inherent to the handmade nature of the Product and do not constitute a lack of conformity, provided the Product matches the description on its product page.
3.3 Availability. Products are offered while stocks last. If a Product is unavailable after the order, T-BUMP informs the Customer as soon as possible. T-BUMP then refunds the full amount paid, unless the Customer prefers a substitute Product or a credit note. The choice belongs to the Customer.
Article 4. Prices
Prices are displayed in the currency offered to the Customer based on their country of connection. The price due is the one shown just before payment is confirmed, in the currency then displayed, including delivery costs when they have already been calculated. No conversion back into euros is required at the time of payment. T-BUMP benefits from the VAT exemption for small businesses (Article 293 B of the French General Tax Code). Displayed prices are net and VAT is not applicable.
Delivery costs are shown separately, before the final confirmation of the order. T-BUMP may change its prices at any time. The applicable price is the one in force at the time the order is confirmed.
Article 5. Order
The Customer selects the Products, adds them to their cart, checks the order details (Products, prices, delivery costs, address) and accepts these Terms of Sale. The order becomes final once payment is confirmed.
A confirmation email summarizes the order. T-BUMP may refuse an order before accepting it, in particular in the event of a payment dispute on a previous order or reasonable suspicion of fraud. If a payment has already been collected, the amounts are refunded.
Article 6. Payment
Payment is made online, at the time of the order, by the means of payment offered on the Site (bank card and the other means displayed at checkout). Payments are secured by the Site's payment provider. T-BUMP does not retain any of the Customer's banking data.
Article 7. Delivery
Products are delivered to the address given by the Customer, in the zones indicated on the Site at the time of the order. The delivery date or time frame communicated before the order is the one the Customer can rely on.
If T-BUMP does not deliver on the agreed date or within the agreed time frame, the Customer may, under the conditions of Articles L. 216-6 and L. 216-7 of the French Consumer Code, terminate the contract by registered letter with acknowledgment of receipt or by a written notice on another durable medium, if, after having called on T-BUMP to deliver within a reasonable additional period, T-BUMP has not complied. The contract is terminated upon receipt of this notice, unless T-BUMP has performed in the meantime. The Customer is then refunded the full amount paid, no later than fourteen days after the date on which the contract was terminated. The Customer is not required to issue a formal notice to T-BUMP where it has refused to deliver, or where the delivery date was an essential condition of the contract.
The transfer of the risk of loss or damage occurs when the Customer, or a third party designated by them other than the carrier, takes physical possession of the Products.
Article 8. Right of withdrawal and returns
8.1 Principle. In accordance with Articles L. 221-18 et seq. of the French Consumer Code, the Customer has fourteen calendar days from receipt of the Product (or of the last Product, in the case of separate deliveries) to withdraw, without giving a reason or incurring a penalty. Return costs remain at their expense under the conditions of Article 8.5.
8.2 Made-to-measure or clearly personalized pieces. In accordance with Article L. 221-28, 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalized. Only these Products may be marked as non-returnable on their product page, before the order. A one-of-a-kind piece, a small series or a piece already made remains returnable, even if it is handmade. The Customer acknowledges having read this notice when it appears on the product page.
8.3 How to withdraw. The Customer notifies their decision to T-BUMP, and not to the Designer, before the end of the 14-day period, by email to contact@t-bump.com, or by any other means indicated on the Site (contact form or other channel accessible from the Site). They then have 14 days from this notification to return the Product to the address provided by T-BUMP. A contact form, including a template withdrawal notice, is available for this purpose.
8.4 Condition of the Product. The Product is returned unworn, unused, complete, and in its original packaging where possible (tags, pouches, boxes, certificates). The Customer is liable for any diminished value resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the Product. This diminished value may be deducted from the refund.
8.5 Return costs. The cost of returning the Product to T-BUMP is borne by the Customer. This information is given to them before the order is confirmed, in accordance with Article L. 221-23 of the French Consumer Code.
8.6 Refund. The refund period is 14 days from the day the Customer informs T-BUMP of their withdrawal, in accordance with Article L. 221-24 of the French Consumer Code. T-BUMP may withhold payment until it has received the Product or proof of shipment, whichever is earlier. The Product may be examined by T-BUMP or by the Designer who receives it. If the Product arrives after these 14 days, the examination takes place as soon as it is received by the person in charge of checking it, and T-BUMP refunds without delay after this examination, on the same day or the next day, after any deduction for diminished value. The time taken to forward it to the Designer does not create a new period. T-BUMP refunds the full amount paid, including the initial delivery costs of the cheapest standard option offered on the Site. If the Customer chose a more expensive delivery method than standard, only the standard rate is refunded. The refund is made using the same means of payment, unless the Customer expressly agrees to another means.
Article 9. Legal warranties
9.1 Legal guarantee of conformity. The Products benefit from the legal guarantee of conformity under Articles L. 217-3 et seq. of the French Consumer Code. The Customer has two years from delivery of the Product to take action. They may choose repair or replacement, subject to the cost conditions provided by law. They are exempt from proving the lack of conformity during the twenty-four months following delivery.
9.2 Guarantee against hidden defects. The Products also benefit from the guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code. The Customer may choose rescission of the sale or a reduction of the price, in accordance with Article 1644 of the French Civil Code.
To assert either of these guarantees, the Customer contacts T-BUMP using the details in Article 15.
Article 10. Liability
T-BUMP is not liable for non-performance of the contract in the event of force majeure, within the meaning of Article 1218 of the French Civil Code, or fault of the Customer. Nothing in these Terms of Sale excludes or limits the legal guarantee of conformity, the guarantee against hidden defects, or the Customer's rights in the event of late delivery or withdrawal.
Article 11. Intellectual property
The elements of the Site (texts, visuals, logos, T-BUMP brand) and the Designers' creations are protected. They remain the property of T-BUMP or the Designers concerned. Any reproduction or use, in whole or in part, without prior authorization is prohibited.
Article 12. Personal data
T-BUMP, as data controller, collects and processes the Customer's data for order management, customer relations and, where applicable, marketing, with their consent, in accordance with Regulation (EU) 2016/679 and the French Data Protection Act (loi Informatique et Libertés). The Customer may exercise their rights of access, rectification, erasure, restriction, objection and portability by writing to contact@t-bump.com. Details are in the Site's privacy policy.
Article 13. Mediation and complaints
In the event of a dispute, the Customer first contacts T-BUMP using the details in Article 15, in order to seek an amicable solution.
In accordance with the provisions of the French Consumer Code on the consumer dispute mediation process, after having contacted us and failing a satisfactory response, you may use a consumer mediation procedure free of charge with: CM2C, 49 rue de Ponthieu, 75008 Paris. Tel.: 01 89 47 00 14. Website: https://www.cm2c.net/declarer-un-litige.php. Email: litiges@cm2c.net.
Article 14. Governing law
These Terms of Sale are governed by French law. This does not deprive the consumer Customer of the protective rules of their country of residence where these are mandatory. In the event of a dispute, and after an attempt at amicable resolution, the competent courts are those designated by the rules of procedure, in particular those that protect the consumer.
